If the matter does proceed to a final hearing your Solicitor will arrange for any of your witnesses who are important in proving your case to be present at Court and you will normally be represented by a specialist Barrister. Your Barrister will normally present all your evidence to the Court. Thereafter, the Defendant tests your evidence and presents their evidence and the Judge is then required to make findings of fact and thereafter apply the law. If your claim is successful the Court will normally Order the Defendant to pay you compensation and to also pay your legal costs, to be assessed by the Court in the absence of any agreement. Compensation is normally payable within 21 days.
