Medical Evidence

The Solicitor will normally arrange to have you medically examined by a specialist Consultant with an interest in asbestos diseases. The Consultant will prepare a report for the Solicitor but, under the Civil Procedure Rules, any report will be addressed to the Court. However, the Solicitor will not disclose that report to anybody without your permission and, as such, you will be sent a copy of the report for your agreement prior to it being disclosed. Do not be surprised if your past employers’ Insurers also arrange to have you medically examined by their own expert. It is not unusual for the two medical experts to disagree about some aspect of your medical condition.

All our panel Solicitors have access to expert medical witnesses throughout England and Wales who are willing to prepare reports on behalf of Claimants.

If you are in agreement with the medical report it can then be disclosed to your opponent.
